Bikes For Sale Live Area

Terms and Conditions

 

These Terms and Conditions apply to any person who brings a motorcycle to the MCN Festival of Motorcycling 2019 (the “Event”) with a view to selling it at the Bike For Sale Live Area (the “Area”) (a “Seller”), as well as to any person who agrees to purchase a motorcycle from the Area (a “Buyer”).

By attempting to sell a motorcycle in the Area, or by agreeing to purchase a motorcycle from the Area, you are indicating your acceptance to be bound by these Terms and Conditions.

The Event is a Motorcycle Festival put on by Bauer Consumer Media (the “Organisers”, “we”, “us”, “our”), a company registered in England and Wales with company number 01176085, whose registered address is Media House, Peterborough Business Park, Lynch Wood, Peterborough, PE2 6EA.

1. General

The purpose of the Area is solely for the exhibition and promotion of motorcycles that are for sale by prospective Sellers to visitors of the Event.
The role of the Organisers in relation to the Area is only to provide an area for the advertisement and sale of motorcycles, and not to monitor, control or be responsible for any transactions that take place within the Area.
We cannot guarantee that by bringing your motorcycle and displaying it within the Area, you will sell it.
The Area is open to Sellers and Event visitors between 9:00am until 6:00pm on Saturday and 9:00am until 5:00pm on Sunday (the “Opening Times”), and Sellers are responsible for looking after and ensuring the security of their motorcycle between these times.

2. Arrival and Set-Up

2.1.   Prospective Sellers must bring with them and present on request by us a valid driving licence with photo ID and the original V5 document that identifies them as the legal owner of the motorcycle they wish to sell (the “Documentation”). Photocopies will not be accepted.

2.2.   On arrival, all Sellers must bring their motorcycle to Gate 14, and register by providing their personal details and Documentation.

2.3.   Spaces in the Area will be allocated on a first-come, first-served basis. We reserve the right to turn prospective sellers away if we cannot accommodate them or the Area has reached capacity.

2.4.   The Organisers may request to move the Seller to another part of the Area at any time. Allocation to any particular part of the Area will not constitute any agreement, warranty or representation by the Organisers that the Seller is entitled to exhibit their motorcycle in the Area at a particular location.

2.5.   The Organisers reserve the right not to allow a prospective seller exhibit or sell a motorcycle if they do not have the correct Documentation, or if we doubt the authenticity of the Documentation. 

2.5.   The Organisers reserve the right in their absolute discretion to exclude or remove from the Area any person whose presence (in the sole opinion of the Organisers) is or is likely to be undesirable.

 

3. Licensor and Licensee

3.1.   As regards any space in the Area allotted to a Seller at the Event, the relationship of licensor and licensee shall exist between the Organisers and the Seller. In case of any breach or non-observance by the Seller of any of these Terms and Conditions, the Organisers shall have the right to revoke the licence, remove the Seller and offer such space to any third party. This shall be without prejudice to any other right or remedy which is available to the Organisers.

 

4. Seller’s Responsibilities

4.1.   The Seller is permitted to display posters, banners, cards, leaflets, flyers and/or signs (“Promotional Material”), but the Organisers reserve the right to remove any Promotional Material that:

(a) is not displayed within the Seller’s allocated space; or

(b) is, in the Organiser’s sole discretion, illegal, libellous or of any obscene nature or may infringe the rights of any third party or which the Organisers consider to be undesirable or detrimental to the Event (in the sole opinion of the Organisers including but not limited to material advertising competitor events), to other Sellers or the general commercial interests of the Organisers or any other company from time to time part of the same group of companies of which the Organisers form part.

4.2.   The Organisers reserve the right to affix numbers or labels on any motorcycles in any position.

4.3.   Sellers cannot under any circumstances, canvas visitors in the aisles, or in any other areas of the Event outside the Area.

4.4.   Sellers are responsible for the cost of making good, restoring or renewing in all cases of damage or dilapidation to the Area or any part thereof, whether caused by themselves, their agents or contractors or by any person or persons employed or engaged on their behalf by any such agent or contractor.

4.5.   Sellers shall at all times ensure that the space in which they exhibit their motorcycle is clean, tidy and well presented during the Exhibition opening times.

 

5. Liability  

 The role of the Organisers is purely to provide an Area where prospective Sellers can exhibit their motorcycles. We will not monitor or control, and accept no responsibility or liability for, any transactions, sales, purchases, agreements, refunds, replacements or representations made by Sellers or Buyers in the Area (including but not limited to information about a motorcycle’s specifications, quality, history and/or safety).
Outside of the times set out in clause 1.4 above, the Area will be locked and not able to be accessed by Sellers, Buyers or any members of the public.
The Area will open 30 minutes before the Opening Times for Sellers to be present with their motorcycles, if so required, prior to the public arriving in the Area. It will also allow the opportunity for any sold motorcycles to be removed from the Area under the supervision of the security team and the owner.
The Seller shall not have any claim against the Organisers in respect of any loss or damage incurred by the Seller as a result of the Event or Area failing (for whatever reason) to be held or the Area being or becoming wholly or partially unavailable for whatever reason.
The Buyer shall not have any claim against the Organisers for any issues with a motorcycle purchased in the Area.

 

6. Restrictions

We are unable to accept race bikes in the Area unless prior arrangements have been made with the Organisers no later than 3 May 2019.

 

7.Data

 

7.1.   When filling out the registration form on arrival, you are submitting your personal data to the Organisers. This will be used to process your attendance at the Area. The data submitted on your registration form will be deleted shortly after the Event.

7.2.   The Organisers reserve the right to provide your details to any regulatory, governmental or law enforcement agencies who may request them or to investigate misuse of the Area or any breach or potential breach of these Terms.

7.3.   Notwithstanding the above, if you have consented to do so on your registration form, the Organisers may store your email address to send you emails about future events. You can unsubscribe at any time by following the instructions given in our privacy policy or in the emails that we send to you.
